Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Stone Stories. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Stone Stories (“Stone Stories,” “we,” “our,” or “us”) provides a web-based platform that allows users to create, host, and manage digital memorial pages linked to physical QR codes (“Service”). The Service is accessible at stonestoriesqr.com.
2. Account Creation & Eligibility
To use the Service, you must:
- Be at least 18 years of age, or have the consent of a parent or guardian.
- Provide accurate and complete registration information, including a valid email address.
- Maintain the security of your account password and notify us immediately of any unauthorized access.
- Use a single account per person. Creating multiple accounts to circumvent restrictions is prohibited.
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions & Payments
3.1 Subscription Plans
Stone Stories offers monthly subscription plans that provide access to memorial hosting features. Plan details, pricing, and included features are described on our pricing page and are subject to change with reasonable notice.
- Essential: $4/month — 1 memorial, up to 50 photos, 1 QR code included.
- Family: $9/month — 5 memorials, unlimited photos, video & audio, 2 QR codes included.
- Legacy: $19/month — Unlimited memorials, all media types, 5 QR codes included.
3.2 Billing
Subscriptions are billed monthly in advance. Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis until you cancel.
3.3 Cancellation & Lapsed Subscriptions
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. If payment fails or your subscription lapses:
- Your memorial pages will be temporarily deactivated.
- QR codes will redirect visitors to a reactivation page where they may donate toward restoring the memorial.
- Your data is retained for 90 days after lapse before deletion.
- You may reactivate your subscription at any time to restore access.
3.4 Refunds
Subscription fees are generally non-refundable. We may issue refunds at our discretion in cases of billing errors or extenuating circumstances. Please contact support@stonestoriesqr.com for refund requests.
4. QR Code Products
Physical QR code products (stickers, metal plaques) are sold as one-time purchases separate from subscriptions. By ordering a QR code product, you agree to the following:
- QR code products ship to the address you provide. We are not responsible for delivery failures due to incorrect addresses.
- Physical QR code products are non-refundable once production has commenced.
- QR codes link to your memorial page hosted on Stone Stories. The QR code will not function if your subscription lapses and the memorial is deactivated.
- We are not responsible for damage to physical QR code products after delivery.
5. Content Ownership & License
5.1 Your Content
You retain full ownership of the content you upload to Stone Stories, including photographs, videos, audio recordings, biographical text, and all other materials (“User Content”). We do not claim ownership of your User Content.
5.2 License to Us
By uploading content, you grant Stone Stories a non-exclusive, worldwide, royalty-free license to host, display, and deliver your User Content solely for the purpose of providing the Service. This license terminates when you delete the content or close your account.
5.3 Content Responsibilities
You are solely responsible for the content you upload. You represent that you have all necessary rights, permissions, and consents to upload and display the content, including any photographs or information about third parties or deceased persons. You must not upload content that:
- Infringes the intellectual property rights of any third party.
- Is defamatory, harassing, threatening, or abusive.
- Violates the privacy of any living person without their consent.
- Contains illegal content, malware, or spam.
- Impersonates another person or entity.
We reserve the right to remove content that violates these Terms without prior notice.
6. Memorial Ownership & Transfers
The person who creates a memorial is its “owner” and has full administrative control. Memorial ownership may be transferred to another user via the transfer feature in the dashboard. Once a transfer is accepted, the new owner assumes full responsibility for the memorial.
Co-editors may be invited to help manage a memorial but cannot transfer ownership or delete the memorial.
7. Privacy Settings
Memorial pages can be set to Public, Password-Protected, or Family-Only. You are responsible for choosing the appropriate privacy level for your memorial. Public memorials are accessible to anyone with the URL or QR code. Stone Stories is not responsible for unintended access to content that you have made public.
8. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Use automated means to access or scrape the Service without our written permission.
- Interfere with the security, integrity, or availability of the Service.
- Create fake or fraudulent memorial pages.
- Use the Service for commercial advertising or unsolicited marketing.
9. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service immediately ceases. Memorial content will be deleted after the retention period described in our Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of content due to technical failures. We strongly encourage you to maintain your own copies of important content.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STONE STORIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts located in Delaware, and you consent to personal jurisdiction in such courts.
13. Changes to Terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on our website. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
